By registering or using RaceYourTrack® you agree to be bound by these Terms of Use.

Payment processing: Paddle.com Market Ltd.. Invoices are issued by this provider. Your contractual relationship regarding the use of RaceYourTrack® exists with us.

1. Scope

These terms govern the use of the platform RaceYourTrack®, offers services such as route analysis, GPX/TCX evaluation, performance analysis, triathlon databases, team training comparisons, and aerodynamic optimization.

2. Registration & Account

  • You must be of legal age and provide accurate information.
  • You are responsible for the security of your access data.
  • We may suspend accounts in case of abuse or violations.

We reserve the right to restrict the use or to create accountsblock if the platform is abusive or used in a waythat jeopardizes the stability or security of the system.

3. Services & Service Description

To perform simulations, race plans, power plans, route analyses, and other evaluations, users must provide or import certain performance, body, equipment, and route data, e.g. weight, height, performance values, FTP/CP, air and rolling resistance, GPX/TCX files, weather data, or route data. This information is a technical requirement for calculating and displaying the simulation and is processed as part of the service.

Race Plans, Power Plans & TrackIQ

Race plans, power plans, TrackIQ outputs, time predictions, and aerodynamic, performance, or pacing recommendations created by the platform are based on mathematical models, algorithms, and the data available or entered at the time. They are approximations and simulations and do not constitute individual medical, sports-medical, safety-related, or sports-science clearance for training or competition.

Actual performance and safety during training or competition may differ significantly from the calculated values, particularly due to daily form, health, fatigue, heat, wind, weather changes, traffic, route changes, group dynamics, defects, inaccurate sensors, uncalibrated power meters, differing aerodynamics, nutrition, hydration, or tactical decisions.

Users remain responsible at all times for checking the plausibility of the results, managing their own effort, making decisions to stop or withdraw, choosing equipment, nutrition, and hydration, complying with traffic, event, and safety rules, and respecting their physical limits.

No guarantee of success

We do not guarantee any specific training or competition results, including any specific race times, placements, qualifications, performance improvements, victories, prize money, sponsorship benefits, contracts, or other sporting or economic outcomes.

Export files & third-party platforms

Where the platform generates export files, training files, or data for third-party platforms, devices, or software, users are responsible for checking them before use. We do not guarantee that exported files are fully compatible with all devices, apps, platforms, or competition requirements.

The specific service scopes are presented in our service description & price list: Plans & Prices. This description is part of the contract. Changes apply only to new contracts or from the next renewal of existing subscriptions, unless expressly agreed otherwise.

4. User content & data

All rights to uploaded content remain with the user. We obtain a simple, non-exclusive usage right for processing within the scope of the service. Illegal content or content for which there is no authorization is prohibited.

If users upload, import, or process data relating to other persons, e.g. athletes, team members, or customers, they must ensure that they are authorized to do so and that they meet all required consent, information, and other legal requirements. This applies in particular to performance, health, heart rate, training, and competition data.

It is prohibited to upload or publish content that unlawful, offensive, discriminatory, defamatory, are pornographic, glorify violence or harmful to young people.

The use of available storage space is governed by the principle of fair use. This means the storage space is intended for normal use of the platform. Excessive or improper use (e.g., mass uploading of large files, automated uploads, or permanent data storage unrelated to the use of the service) may be limited or deleted to maintain system stability.

5. Strava Integration

When connecting to Strava, data will be imported via the Strava API and processed in the service – after your consent. The terms and privacy notices of Strava also apply. You can revoke the Strava connection at any time in your Strava account (My Apps → Revoke Access).

6. Prices, Subscriptions & Payments

  • All prices are total prices including statutory value-added tax (if applicable).
  • Billing at the specified interval (monthly/yearly, etc.); the subscription will automatically renew for the same interval unless cancelled in due time.
  • Cancellation: possible at any time until the end of the current billing period via the account; already paid periods are not automatically refunded unless mandatory legal rights apply. We may grant refunds on a case-by-case basis as a gesture of goodwill.
  • Free trial period (if offered): Duration according to the tariff table. If not canceled in time before expiration, the trial period automatically converts to a paid subscription.
  • Up-/downgrades are valid from the next billing period; any price changes will take effect only upon renewal, not during an already paid period.
  • Payments are processed through the aforementioned payment processor (MoR). Any refunds/chargebacks may result in the suspension of access.

7. Liability

We are liable for intent, gross negligence, and for damages resulting from injury to life, body, or health in accordance with statutory provisions. To the extent permitted by law, our liability for slight negligence is limited to typical, foreseeable damages.

To the extent permitted by law, we are not liable for damages, disadvantages, or losses arising from users using simulations, race plans, power plans, TrackIQ outputs, time predictions, export files, or other platform outputs without review, or relying on them as the sole basis for training, competition, medical decisions, safety decisions, equipment choices, tactics, nutrition, or hydration.

To the extent permitted by law, we are not liable for sporting or economic consequential damages such as missed goals, lower placements, failure to qualify, race withdrawals, lost prize money, lost sponsorship benefits, lost contract opportunities, reputational damage, or other indirect damages, unless they are based on intentional or grossly negligent conduct on our part.

To the extent permitted by law, we assume no liability for the accuracy, completeness, availability, or timeliness of external data sources, interfaces, or third-party providers, e.g. Strava, weather services, map services, elevation data, device manufacturers, payment providers, or other platforms.

We accept no liability for the loss or damage of uploaded or created data (e.g. GPX/TCX files, Performance data, team data), unless it is caused by intentional or grossly negligent conduct on our part was caused. Users are responsible for making backup copies of their data.

We do regular backups, but we can't do a full and guarantee data recovery service at any time.

All rights to the underlying software, the source code, the technical systems and the design of the platform shall remain with us or our licensors. Use beyond the contractually agreed beyond the intended purpose is not permitted.

No medical advice

All content on the platform (e.g., texts, images, graphics, evaluations, simulations) is intended solely for informational and simulation purposes and does not replace advice from doctors or other medical professionals. It does not constitute a medical diagnosis, treatment, or recommendation. For health-related questions, contact your healthcare providers. In emergencies, dial emergency number 144 (rescue) or 112.

We are not a healthcare provider within the meaning of Austrian law, and no doctor-patient, therapist-patient, or any other treatment relationship is established through the use of the platform.

No individual training, competition, or safety advice

The platform does not replace personal support from qualified coaches, physicians, sports scientists, physiotherapists, nutrition advisors, or other professionals. In particular, race plans, power plans, pacing suggestions, or performance predictions do not replace an individual assessment of health status, resilience, injury risks, weather conditions, route safety, or fitness to compete.

In the event of pain, illness, injury, dizziness, shortness of breath, chest pain, circulatory problems, unusual exhaustion, or other warning signs, platform outputs must not be understood as an instruction to continue training or competing. In such cases, the effort should be reduced or stopped and, if necessary, medical assistance should be sought.

Professional use by coaches, teams & support staff

The platform may be used by coaches, teams, clubs, sports directors, sponsors, performance diagnosticians, or other support staff. In this case, the professional interpretation and application of the results are solely their own responsibility. We are not a party to the contractual or support relationship between the coach, team, sponsor, support person, and athlete.

Coaches, teams, and other professional users are responsible for ensuring that they are authorized to process and upload the data of the athletes concerned, that they properly inform them, and that they do not use the results without review or outside their professional area of responsibility.

To the extent permitted by law, we are not liable for advice, training management, race decisions, tactical instructions, medical assessments, nutrition decisions, equipment decisions, payments, sponsorship benefits, or other services provided by coaches, teams, sponsors, or support staff, regardless of whether they use the platform or our services.

No guarantee of data accuracy, model precision & real-world conditions

To the extent permitted by law, we make no representation or guarantee regarding the accuracy, completeness, timeliness, or suitability of the displayed, imported, or calculated data. Statutory warranty rights remain unaffected. This applies in particular to route layouts, map/elevation data, weather data, sensor data, performance data, aerodynamic assumptions, rolling resistance, and model- or algorithm-based simulations and forecasts, e.g. power plans, race plans, aerodynamic, performance, or time estimates.

Results are approximations and may differ significantly from actual conditions. Users must check, especially before training, competition, or exporting to devices, whether the values are plausible, up to date, and suitable for the specific purpose.

Mandatory statutory liabilities remain unaffected, in particular for intent, gross negligence, and personal injuries.

Users shall indemnify us against any third-party claims arising from content, data, or actions they cause while using the platform, provided they are responsible for such content, data, or actions.

Availability & Maintenance

We make every effort to ensure the service is available without interruption. However, short-term outages may occur, in particular due to maintenance work, security updates, or technical issues. Claims arising from temporary unavailability are excluded unless the downtime was caused by intent or gross negligence on our part.

8. Duration & Termination

Users can delete accounts at any time. We may discontinue the service for important reasons. Statutory retention obligations remain unaffected.

If there is no active subscription (currently more than 6 months), we reserve the right to permanently store the account and all associated data. Prior to such deletion, we will inform you at least 30 Days in advance by e-mail to the last e-mail address stored.

9. Change of content & change of price

We can further develop features and make non-essential changes. Essential performance reductions or price increases for existing subscriptions will be announced at least 30 days in advance and will apply – unless challenged – only from the next renewal. In this case, you can cancel at the end of the current period.

10. Feedback & Suggestions

If you send us feedback, ideas, or suggestions, we may use them free of charge and without any entitlement to compensation to further develop our platform and services.

11. Choice of Law & Consumer Rights

Austrian law applies. Mandatory consumer protection regulations of your country of residence remain unaffected.

12. Complaints & Dispute Resolution

You can send complaints via email to info@creativemaker.at align.

Note: We are not obligated to participate in an alternative dispute resolution procedure. In the specific case of a dispute, we inform consumers on a durable medium about the responsible bodies and indicate whether we will participate.

13. Support & Accessibility

We strive to respond to support requests as quickly as possible. However, there is no entitlement to constant availability or immediate resolution of issues.

14. Final Provisions & Status

If any provision of these terms is or becomes wholly or partially invalid or unenforceable, the validity of the remaining provisions shall not be affected. In place of the invalid provision, a regulation shall apply that most closely reflects the economic intent of the original provision.

We may amend these terms to the extent permitted by law. The current version is available on this page. Users will be notified of material changes in an appropriate manner.
